Terms and Conditions of Sale

1. Scope and Agreement

These Terms and Conditions apply to all orders placed via www.farsonbrewery.com for delivery within the European Union (EU) and the United States (US). By placing an order, you agree to be bound by these terms.

2. No Right of Cancellation or Return (Perishable Goods)

  • EU Regulation: Under Article 16(d) of the EU Consumer Rights Directive, the right of withdrawal (the standard 14-day return policy) does not apply to the supply of goods that are liable to deteriorate or expire rapidly.

  • US Policy: Food products are generally exempt from standard "cooling-off" periods and return requirements due to federal and state health and safety regulations.

  • Policy: Because our products are food items, all sales are final. Once an order is processed, it cannot be canceled, and items cannot be returned for a refund or exchange. “COOL OFF PERIOD” does not apply!

3. Mandatory Contact Information & Address Accuracy

To ensure the safe and timely delivery of goods, the buyer is strictly required to provide:

  • Correct Shipping Address: You must provide a complete and accurate delivery address. We cannot ship to P.O. Boxes.

  • Telephone Number & Email: You must provide a valid telephone number and a monitored email address. This is required for the carrier to provide delivery updates, "out-for-delivery" notifications, or to contact you if there are issues accessing the property.

  • Responsibility for Extra Costs: If a shipment is delayed, returned, or requires re-routing due to an incorrect address or missing contact information provided by the buyer, the buyer is responsible for all additional shipping fees and administrative costs.

  • Liability: NC24 ApS and NC2024, Inc. are not responsible for lost, delayed, or spoiled shipments resulting from incorrect addresses or the inability of the carrier to reach the buyer. No refunds will be issued for items that perish due to delivery failures caused by inaccurate buyer information.

4. Pricing and Payments

  • EU Customers: Prices include applicable VAT unless stated otherwise.

  • US Customers: Prices exclude sales tax. Applicable sales tax will be calculated and added at checkout based on the shipping destination.

  • Customs/Duties: For cross-border shipments, the buyer is the importer of record and is responsible for any import duties, taxes, or customs clearance fees.

5. Shipping and Delivery

  • Risk of Loss: Ownership and risk of loss (including spoilage) pass to the buyer upon 1st attempt of delivery to the address provided.

  • Unattended Deliveries: If the carrier leaves the package at the provided address because the buyer was unavailable, the risk of theft or temperature-related damage lies solely with the buyer. Any issue must be resolved between the buyer and carrier.

6. Damaged or Defective Goods

While we do not accept returns for "change of mind," we stand by our quality:

  • If your product arrives damaged, contaminated, or differs significantly from what you ordered, you must state it on the delivery note and contact us within 24 hours of receipt.

  • You must provide photographic evidence of the damage and the packaging.

  • If a damage is verified, we will, at our discretion, provide a replacement or a refund.

7. Health and Allergen Information

  • Allergen information is provided on the product packaging and/or the website.

  • It is the customer’s responsibility to review ingredients before purchase. We are not liable for allergic reactions if the ingredients were accurately disclosed at the time of sale.

8. Governing Law

  • For EU residents: These terms are governed by the laws of Denmark and the seller is NC24 ApS, subject to mandatory local consumer protection laws.

  • For US residents: These terms are governed by the laws of the State of California and the seller is NC2024, Inc., without regard to conflict of law principles.
